1. General

1.1 Julia Bamberg provides her services in the areas of coaching, consulting, and retreats on the basis of the following General Terms and Conditions (GTC). These apply to all contracts with clients in the version valid at the time of conclusion of the contract. Upon commissioning, these terms and conditions are deemed to be accepted unless the client objects immediately. Deviating provisions are only binding if they have been confirmed in writing by Julia Bamberg.

1.2 The services offered by Julia Bamberg are generally service contracts. No specific success is owed unless this has been expressly agreed in writing.

2.Services offered and conclusion of contract

2.1 Julia Bamberg offers her services in both private and professional contexts and as part of retreats. The services are described on the website. The offers are subject to change and constitute an invitation to the client to submit an offer.

2.2 A contract is only concluded when Julia Bamberg confirms the client's offer in writing (e.g., by email) or an automatically generated confirmation email is sent.

2.3 For bookings made via an online booking system, the terms and conditions of that system also apply.

2.4 There is no entitlement to participate in the services offered. Julia Bamberg reserves the right to reject requests without giving reasons.

3. Prices, fees, and payment terms

3.1 All prices are quoted in euros. The prices quoted for end consumers include 19% VAT. For services provided to businesses, statutory sales tax will be charged in addition. Any additional costs (e.g., travel, accommodation, or telephone costs) will be invoiced separately, unless otherwise agreed.

3.2 Unless expressly agreed otherwise, the client is liable for the agreed remuneration. Payments are due immediately upon invoicing without deduction.

3.3 Installment payments are only possible with express written agreement. These do not constitute a claim to partial services. Partial cancellation is excluded.

4. Online appointments and cancellations

4.1 Online individual appointments are arranged on a case-by-case basis.

4.2 Cancellations are free of charge up to 24 hours before the appointment (in writing by email). In the event of later cancellations or no-shows, the full fee will be charged.

4.3 Julia Bamberg may postpone or cancel appointments for important reasons. In this case, any amounts already paid will be refunded in full if no alternative appointment can be found.

4.4 All agreed services must be used within 12 months of the conclusion of the contract, otherwise the claim expires.

5. Withdrawal and cancellation for individual coaching sessions & retreats

5.1 For cancellations up to 30 days before the start of the individual coaching/retreat, 30% of the total amount will be charged as a flat-rate fee.

5.2 For cancellations between 30 and 7 days before the start of the individual coaching/event, 50% of the total amount will be charged.

5.3 In the event of short-term cancellation (less than 7 days), the entire amount is payable.

5.4 In the event of serious reasons (e.g., illness with a doctor's note, death of a close relative, natural disasters), only the costs specified in section 5.1 will be charged. A replacement date will be sought jointly.

6. Content and copyrights

6.1 As part of the service provision, clients receive documents (e.g., worksheets, audio/video files) that are intended for personal use.

6.2 All content is subject to Julia Bamberg's copyright. Any disclosure or publication, even in part or free of charge, is not permitted without express written consent.

7. Insurance coverage

Each client acts on their own responsibility and bears full responsibility for themselves and their actions. Coaching is not a substitute for psychotherapy or medical treatment. Participation requires mental and physical stability.

8. Liability

8.1 Julia Bamberg shall only be liable for intent and gross negligence. Liability for indirect damages is excluded.

8.2 Success cannot be guaranteed. The client is responsible for their own development.

8.3 Julia Bamberg accepts no liability for third-party software or tools.

9. Confidentiality

Julia Bamberg undertakes to maintain absolute confidentiality regarding all information that becomes known to her in the course of the collaboration, even after the end of the contract.

10. Data protection

10.1 Personal data is processed in accordance with the statutory data protection provisions.

10.2 The data is used exclusively for contract processing and is not passed on to uninvolved third parties.

10.3 Further information can be found in the privacy policy.

11. Distinction from psychotherapy

11.1 Coaching and my support are based on partnership and cooperation and are not a substitute for medical or psychotherapeutic treatment.

11.2 The goal is personal development and not the alleviation of clinical symptoms.

12. Right of withdrawal for consumers

12.1 If the client is a consumer within the meaning of § 13 BGB (German Civil Code) and a coaching or mentoring service has been booked exclusively via means of distance communication (e.g., online booking, email, or telephone), the client is generally entitled to a statutory right of withdrawal. The following cancellation policy applies exclusively to coaching and consulting services that are not tied to a fixed event period (e.g., retreats, individual retreats).

Right of cancellation

The client has the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the date of conclusion of the contract.

To exercise the right of cancellation, the client must inform Julia Bamberg (email: mail@juliabamberg.com) of their decision to withdraw from this contract by means of a clear statement (e.g. by email).

To comply with the withdrawal period, it is sufficient to send the notification of exercising the right of withdrawal before the expiry of the withdrawal period.

Consequences of withdrawal

If the client withdraws from this contract, Julia Bamberg shall reimburse all payments received from the client without delay and at the latest within fourteen days from the day on which the notification of withdrawal from the contract was received. The same means of payment used for the original transaction will be used for this repayment, unless expressly agreed otherwise.

If the client has requested that the service should commence during the withdrawal period, they must pay Julia Bamberg the full amount.

12.2 The client acknowledges that for coaching packages that include retreats, individual retreats, and online coaching, the right of withdrawal is excluded for the retreat portion.

**No right of withdrawal for retreats & individual retreats**

According to § 312g para. 2 no. 9 BGB (German Civil Code), **there is no right of withdrawal for contracts for the provision of services in connection with leisure activities** if the contract specifies a specific date or period for the provision of services. This applies in particular to retreats, individual retreats, or events with a fixed date.

12.3 In the case of combined offers (e.g., retreat + online coaching), the following applies: The retreat portion is excluded from the statutory right of withdrawal; the right of withdrawal applies to the online coaching portion in accordance with Section 12.1, provided that it is provided separately and does not take place entirely within the retreat period.

12.4 Commencement of service before expiry of the withdrawal period

The client expressly agrees that Julia Bamberg may commence performance of the commissioned service before expiry of the withdrawal period. The client confirms that they lose their right of withdrawal upon complete fulfillment of the contract by Julia Bamberg.

13. Place of jurisdiction and applicable law

13.1 Spanish law applies, unless mandatory consumer protection regulations dictate otherwise.

13.2 The place of jurisdiction for merchants is the registered office of Julia Bamberg.

13.3 The contract languages are German and English.
